Three different dates to record

On 16 October, the ITA announced that BVIFARS would accept only CRS XML Schema 3.0 from 1 January 2027. It asks institutions to submit historical corrections and previously omitted accounts by 30 November 2026. That instruction should be treated as an operational transition deadline; it does not establish an amnesty or extinguish earlier obligations. [ITA]

The technical cutover is not the commencement of the amended standard. Section 26A, inserted by the Mutual Legal Assistance (Tax Matters) (Amendment) Act, 2026, gives the amendments effect from 1 January 2026. The Act received assent on 26 February and was gazetted on 5 March 2026. These dates describe different events and should remain distinct in internal procedures. [ACT2026]

Classify the account before testing the file

For accounts treated as financial accounts solely because of the CRS amendments, the Act distinguishes accounts maintained on 31 December 2025 from those opened on or after 1 January 2026. Those dates address this particular newly included category. They do not indiscriminately replace the historical dates for every type of account. [ACT2026]

Institutions should retain the legal reason for each classification, rather than only a system flag for pre-existing or new accounts. The same software migration can affect accounts already in scope, newly included accounts and information subject to transitional treatment. Classification requires the rules applicable to each category to be read. This article does not classify any individual account. [ACT2026]

The transitional qualification for roles

Section 26A provides a specific rule for reportable accounts maintained on 31 December 2025. For reporting periods ending by the second calendar year following that date, information about the roles by virtue of which a reportable person is a controlling person or equity interest holder is required only where it is available in electronically searchable data maintained by the reporting financial institution. [ACT2026]

The second following calendar year is 2027. All conditions must nevertheless be retained: a reportable account, the relevant maintenance date, the reporting period and the availability of information. This provision does not generally exempt the account from reporting or permit information that is available to be discarded. Institutions should document what can actually be searched in their existing systems. [ACT2026]

Select the correct schema and preserve corrections

The OECD guide issued in October 2024 is version 4.0, while its corresponding CRS XML schema is version 3.0. It distinguishes file-validation requirements from other reporting requirements and separately addresses corrections. The guide’s version number should therefore not be substituted for the XML schema version. [OECD]

Testing should cover an initial report, a correction and an omitted account while preserving earlier message references. This is an implementation recommendation: successful XML validation does not demonstrate that a reported tax residence or controlling-person classification is substantively correct. Tax specialists and the technology provider should be able to verify different aspects of the same filing. [OECD]

Implement the transition without losing the history

The first step is to reconcile earlier submissions against retained data, identifying absent accounts, correction references, relevant identities and the information supporting classification. The second is to obtain confirmation of the provider’s output format and delivery timetable. Retain test results and actual acknowledgements. An installed software upgrade should not be treated as an accepted submission. [ITA] [OECD]

Finally, domestic scope and effective dates cannot be inferred from the international standard alone. This analysis concerns the identified BVI sources as at 21 October 2026. It does not establish another territory’s rules, certify any software or determine penalties or the consequences of a late correction. A transition problem calls for documented clarification; silence from a portal should not be treated as permission. [ACT2026] [ITA]
